.TX1 *** INTRODUCTION TO DETAILED REALTY SALES AGREEMENT ********
CONTRACT FOR SALE OF REALTY
This agreement is made this date between {VENDOR_NAME} of
{VENDOR_ADDR}, hereinafter called "Vendor", and {PURCHASER_NAME}
of {PURCHASER_ADDR}, hereinafter called "Purchaser", as follows:
.TX2 *** DESCRIPTION OF THE PROPERTY SOLD IN REALTY SALE ********
{!PARNO}. Sale. The Seller agrees to sell and convey and the
Purchaser agrees to purchase all that tract or parcel of land and
premises situate in {PROPERTY_LOCATION} and being described as
follows:

together with all the right, title and interest of the seller in
and to all the land and premises included within all adjoining
streets and roads.
.TX3 *** RESERVATIONS AND EXCEPTIONS TO SELLER IN REALTY SALE ***

Reserving and excepting to the Seller, his heirs and assigns
{RESERVATION}.
.TX4 *** BUILDINGS, STRUCTURES AND FIXTURES INCLUDED IN SALE ****
{!PARNO}. Buildings, Structures and Fixtures. Included in the
sale as a part of said premises are the buildings, structures and
improvements now thereon and the fixtures belonging to the Seller
and used in connection therewith including, if any, all venetian
blinds, window shades, screens, screen doors, storm windows and
doors, awnings, shutters, furnaces, heaters, heating equipment,
stoves, ranges, oil and gas burners and fixtures appurtenant
thereto, hot water heaters, plumbing and bathroom fixtures,
electric and other lighting fixtures, mantels, outside television
antennas, fences, gates, trees shrubs, plants and, if built in,
ventilators, garbage disposers, air conditioning equipment,
dishwashers, washing machines and driers, but excluding
{FIXT_EXCLUDED}.
.TX5 *** MORTGAGE, REAL PROPERTY SOLD SUBJECT TO ****************
{!PARNO}. Sale Subject to Mortgage. The premises are sold and are
to be conveyed subject to a mortgage now a lien of record, a copy
of which is annexed hereto and made a part of this contract, upon
which there is unpaid the principal sum of {BALANCE_SUBJ_TO} with
interest at the rate of {INT_RATE} per annum.
.TX6 *** MORTGAGE, REAL PROPERTY SOLD WITH PURCHASER ASSUMING ***
{!PARNO}. Mortgage Assumption. The Purchaser agrees to assume and
pay the Vendor's existing loan on the property, the principal
balance of which is approximately {BALANCE_BY_ASSUM} (the exact
amount to be adjusted at closing). The Purchaser agrees to pay
all costs in connection with the assumption. Any escrow deposit
held by the holder of the Vendor's loan is to be assigned to the
Purchaser at the closing and the Vendor is to be reimbursed by
the Purchaser for the same. The interest on the Vendor's loan is
to be prorated as of the date of the closing. This contract is
contingent upon the acceptance of the Purchaser by the holder of
the Vendor's loan and on the approval of the Purchaser's credit
by the Vendor. The Purchaser shall furnish the Vendor forthwith
with any credit information requested and will be reimbursed by
the Vendor for any expense incurred by him in obtaining said
information. The Vendor shall, within ten (10) days after receipt
of the credit information, notify the Purchaser in writing that
said credit is approved or disapproved. If disapproved, this
contract shall be null and void and the earnest money deposit
shall be returned to the Purchaser.
.TX7 *** RESTRICTIONS & COVENANTS - REALTY SALE SUBJECT TO ******
{!PARNO}. Restrictions and Covenants. The premises are sold and
are to be conveyed subject to restrictions and covenants, if any,
contained in prior instruments of record.
.TX8 *** LEASES AND TENANCIES - REALTY SALE SUBJECT TO **********
{!PARNO}. Leases and Tenancies. The premises are sold and are to
be conveyed subject to leases and tenancies as set forth in
Schedule A annexed hereto and made a part hereof. The Purchaser
acknowledges that he has examined each of the leases referred to
in said schedule and has initialed the same for identification.
.TX9 *** SURVEY EXCEPTIONS - REALTY SALE SUBJECT TO *************
{!PARNO}. Survey. The premises are sold and are to be conveyed
subject to such state of facts as an accurate survey may
disclose, provided the same does not render the title
unmarketable.
.TX10 *** ZONING ORDINANCES - REALTY SALE SUBJECT TO ************
{!PARNO}. Zoning Ordinances The premises are sold and are to be
conveyed subject to any and all zoning ordinances and regulations
affecting it, if any.
.TX11 *** STREET ENCROACHMENTS - REALTY SALE SUBJECT TO *********
{!PARNO}. Encroachments. The premises are sold and are to
be conveyed subject to encroachments of stoops, areas, cellar
steps, trim and cornices, if any, upon any street or highway
adjacent to the property.
.TX12 *** MECHANIC'S LIENS, SELLER TO FURNISH SECURITY AGAINST **
{!PARNO}. Mechanic's Liens. If improvements or additions have
been completed within six months prior to the sale closing date,
Vendor shall furnish reasonable security against mechanic's liens
or satisfactory evidence of payment of bills covered by such
liens.
.TX13 *** PURCHASE PRICE, MANNER OF PAYMENT TO BE FILLED IN *****
{!PARNO}. Purchase Price. The Purchaser agrees to purchase the
premises and to pay for it the sum of {TOTAL_PRICE} in the
following manner:

{DEPOSIT_AMOUNT} upon the execution and delivery of this
agreement, receipt thereof by check, subject to collection, is
hereby acknowledged by Vendor.
.TX14 *** BALANCE OF PAYMENT ON REALTY SALE CONTRACT BY CASH ****

{BALANCE_AT_CLOSE} in cash or be valid certified check drawn by
the Purchaser to the order of the Vendor upon a bank or trust
company acceptable to Vendor upon the delivery of the deed as
provided herein.
.TX15 *** BALANCE OF PRICE BY ASSUMPTION OF EXISTING MORTGAGE ***

{BALANCE_BY_ASSUM} by the Purchaser assuming and agreeing to pay
the existing mortgage on the property for that amount bearing
interest at the rate of {INT_RATE} per annum.
.TX16 *** BALANCE OF PRICE BY TAKING SUBJECT TO EXISTING MORTGAGE *

{BALANCE_SUBJ_TO} by the Purchaser taking the property subject
to an existing mortgage in that amount bearing interest at the
rate of {INT_RATE} per annum.
.TX17 *** BALANCE OF PRICE BY PURCHASE MONEY MORTGAGE TO VENDOR *

{BALANCE_MTG} by the Purchaser giving back to Vendor a standard
promissory note for that amount, bearing interest at the rate of
{INT_RATE}, payable in equal monthly installments over a period
of {TERM_YEARS} and secured by a standard purchase money mortgage
containing a prepayment option, exercisable on any installment
paying day and a power to confess judgment for non-payment of
principal and interest. Taxes, insurance premiums and special
assessments are to be paid by the Purchaser during the life of
the mortgage.
.TX18 *** MORTGAGE CONTINGENCY CLAUSE FOR REALTY SALE AGREEMENT *
{!PARNO}. Contingent on Loan Commitment. This agreement is
contingent on the Purchaser's ability to obtain a {FIRST/SECOND}
mortgage loan commitment of {MORTGAGE_AMOUNT}. The Purchaser
agrees to apply for said mortgage loan commitment on or before
{MTG_APPL_DATE}. In the event the Purchaser is unable to obtain a
commitment for said mortgage loan on or before {COMMIT_DATE} the
Vendor shall promptly notify the Vendor, or Vendor's broker, and
this contract shall become null and void and all payments made
hereunder shall be refunded and all obligations of the parties to
each other shall terminate. If such notice is not received on or
before the expiration date specified above, the Purchaser shall
be bound to perform the obligations under this contract.
.TX19 *** DATE FOR PAYMENT AND DELIVERY OF DEED *****************
{!PARNO}. Closing. The deed shall be delivered upon the receipt
of the payments and the performance by Purchaser of his
obligations hereunder at {CLOSING_PLACE} at {CLOSING_TIME} on
{CLOSING_DATE}.
